Biden Administration Releases Update on Anticipated Regulatory Initiatives

Twice a year the federal regulatory agencies release an updated “Unified Agenda” that describes and provides a timeline for their ongoing and future regulatory actions. The most recent agenda provides a glimpse of what the Biden Administration may focus on in the final months of that Administration, including finalizing greenhouse gas disclosures for federal contractors and reissuing nationwide permits for specific activities in/near waters of the United States.   • Climate Change Disclosures – Final action: Mar. 6, 2024 – Rule on hold due to litigation

DOD/GSA/NASA (FAR)

  • Disclosure of GHG Emissions and Climate-Related Financial Risk – Final delayed to Dec. 2024

Corps of Engineers

  • Appendix C Procedures for the Protection of Historic Properties – Final Nov. 2024 
  • Reissuance of NWPs – Proposed rule: Dec. 2024 
  • NEPA implementation rules – Proposed rule: April 2025 
  • Section 401 Water Quality Certifications – Proposed rule: Sept. 2024

  • Revised Policy: “Significant portion of its range” – Dec. 2024 
  • Migratory Bird Incidental Take Permit – Proposed rule: Dec. 2024
