House Committee Releases, Senate Votes on Annual Defense Bill; Significant Procurement Reforms Included

On July 1, the House Armed Services Committee overwhelmingly passed (56-0) H.R. 6395, the National Defense Authorization Act for Fiscal Year (FY) 2021. In addition, on July 2, the Senate is set to vote on it’s version of the FY2021 NDAA (S.4049). AGC has provided feedback to both chambers on provisions important to federal construction contractors.

The House Armed Services Committee debated and adopted hundreds of amendments to the bill. The House bill contains a host of procurement and environment provisions, particularly relating to per-and polyfluoroalkyl substances, important to construction contractors. Two provisions would have particular impact on federal construction contractors: 1) An amendment which would require federal agencies to initially pay at least 50 percent of the actual (incurred or committed) cost of the unilateral change order and 2) a provision that would dramatically alter how military construction is procured. AGC has called for of the latter from the bill.

As the Senate is set to vote on its version of the bill, AGC submitted comments on noteworthy amendments proposed to it. AGC will continue to analyze both bills and all amendments proposed to them and will report on any provisions that impact the construction industry. As the legislative process moves forward, AGC will continue to work with Congress and advocate for further reforms important to federal contractors.
