States Sue DOT Over Immigration Enforcement Threats

Twenty states filed a lawsuit against the U.S. Department of Transportation and their attempts to force states to comply with ICE enforcement.

On May 13, 20 states filed a lawsuit against the U.S. Department of Transportation, claiming an “unlawful attempt to usurp” congressional authority by requiring recipients to cooperate with ICE enforcement. You might recall, AGC previously reported on the U.S. Department of Transportation’s (DOT) letter to grant recipients reminding them that they are required to comply with federal laws and regulations – including a prohibition on DEI activities and full cooperation with Immigration and Customs Enforcement.  

The 20 states, all led by Democratic governors, claim the Trump administration is trying to “strongarm them into participating in federal immigration enforcement by threatening to cut off billions of dollars in transportation funding if they refuse to comply.” AGC has reported on attempts by the executive branch to withhold funding – a practice known as impoundment – and noted that such actions would likely result in litigation.
