The AGC is challenging the rule’s legality through two lawsuits, both of which have resulted in temporary injunctions against the rule’s enforcement in 26 states. Leah highlights that, thanks to AGC’s advocacy efforts, the 2023 WOTUS rule is currently not in effect in half the country, emphasizing AGC’s stance against the federal government’s overreach in regulating the nation’s waters.
