		<description><![CDATA[AGC Advocacy Efforts Help Bring Large Bipartisan Victory

On May 15, the Senate overwhelmingly passed its version of the Water Resources Development Act of 2013 (WRDA) by an 83-14 vote. Although the Senate passed the bill by a large, bipartisan margin, 14 senators voted against the bill. Those senators include: Kelly Ayotte (R-N.H.), Richard Burr (R-N.C.), Tom Coburn (R-Okla.), John Cornyn (R-Texas), Ted Cruz (R-Texas), Jeff Flake (R-Ariz.), Dean Heller (R-Nev.), Ron Johnson (R-Wis.), Patrick Leahy (D-Vt.), Lee (R-Utah), John McCain (R-Ariz.), Rand Paul (R-Ky.), Marco Rubio (R-Fla.), Tim Scott (R-S.C.). 		<description><![CDATA[The Senate Judiciary Committee continued consideration of S. 744, the Border Security, Economic Opportunity, and Immigration Modernization Act. This week, the committee discussed sections dealing with temporary worker visas.  The committee will meet tomorrow and again next week with the goal of finishing Committee consideration of S.744 before the week’s end.  The bill mandates e-verify; requires photo identification as part of the documentation; eliminates the patchwork of local immigration laws; provides new avenues for legal immigration; and creates a legal status for undocumented workers currently in the United States. The bill also prohibits employers from “knowingly” hiring an undocumented worker.  In addition, the bill includes a temporary worker program.  However, the program places unique restrictions on the construction industry that prevent construction from fully utilizing the future temporary worker visa program. There was an effort this week to eliminate the arbitrary cap on the construction industry’s use of what are known as “W” visas. This amendment by Senator John Cornyn (R-Texas) was not adopted by the Committee. ]]></description>

Miller, as part of a response to quell an unraveling scandal over the Agency’s admission of selectively screening conservative nonprofit groups seeking tax exemption status under 501(c)(4).  The announcement comes as the administration sought to contain scandals on multiple fronts that may imperil its second-term agenda. 		<description><![CDATA[The U.S. Senate Judiciary Committee began considering the much discussed Senate “Gang of 8” immigration bill – The Border Security, Economic Opportunity, and Immigration Modernization Act. The committee process will allow for the opportunity for greater input and modifications. The current bill addresses many AGC priorities by giving employers certainty that they have complied with the law and certainty that they have received authentic documentation from newly hired employees. The bill also eliminates the patchwork of local immigration laws and provides new avenues for legal immigration by creating a legal status for undocumented workers currently in the United States. The bill would require employers use E-Verify, comply with and retain records of the verification process, and prohibit employers from “knowingly” hiring an undocumented worker.  The bill also includes a temporary worker program; unfortunately, the program places unique restrictions on the construction industry that prevent construction from fully utilizing the future temporary worker visa program.]]></description>

In the event the debt of the U.S. government reaches the statutory debt limit, H.R. 807 would allow the Treasury Secretary to issue debt to the extent necessary to pay principal and interest on certain obligations as outlined in the bill, such as borrowing for debt obligations and Social Security. In other words, it does not raise the debt ceiling, but instead would provide clarity about what was to be done when the Treasury Department hit the limit.]]></description>

		<description><![CDATA[In another victory for the AGC-supported Coalition for a Democratic Workplace (CDW), the U.S. Court of Appeals for the District of Columbia Circuit (DC Circuit) has invalidated a regulation by the National Labor Relations Board (NLRB) that required most private-sector employers to post designated notices informing employees of certain rights under the National Labor Relations Act (NLRA), including the right to organize.  As previously reported, the Board published the controversial final rule in August 2011, but put implementation on hold after the D.C. Circuit issued a temporary injunction on the rule. 		<description><![CDATA[Beginning next Thursday, the U.S. Senate Judiciary Committee will be considering the much discussed Senate “Gang of 8” immigration bill – The Border Security, Economic Opportunity, and Immigration Modernization Act. The current bill is the work of a small, bipartisan group of senators - Schumer (D-N.Y.), McCain (R-Ariz.), Durbin (D-Ill.), Graham (R-S.C.), Menendez (D-N.J.), Rubio (R-Fla.), Bennet (D-Colo.), and Flake (R-Ariz.) – and the committee process will allow for the opportunity for greater input and modifications. The current bill addresses many AGC priorities by giving employers certainty that they have complied with the law and certainty that they have received authentic documentation from newly hired employees. The bill also eliminates the patchwork of local immigration laws and provides new avenues for legal immigration by creating a legal status for undocumented workers currently in the United States. The bill would require employers use E-Verify, comply with and retain records of the verification process, and prohibit employers from “knowingly” hiring an undocumented worker.  The bill also includes a temporary worker program; unfortunately, the program places unique restrictions on the construction industry that prevent construction from fully utilizing the future temporary worker visa program.]]></description>

		<description><![CDATA[In a startling industry defeat, the United States Court of Appeals for the District of Columbia held that the U.S. Environmental Protection Agency (EPA) has the authority under the Clean Water Act (CWA) to change, if not revoke, Section 404 “dredge-and-fill” discharge permits that have already been approved and issued by the U.S. Army Corps of Engineers (Corps).  Mingo Logan Coal Co. v. USEPA, No. 12-5150 (D.C. Cir. April 23, 2013). The federal court ruled that CWA Section 404(c) grants EPA this power “whenever [it] determines” that the discharge will have an “unacceptable adverse effect” on identified environmental resources.]]></description>

Stephen Lynch (D-Mass.-8), in Tuesday night’s special U.S. Senate party primary election. Markey racked up an expected 57-43 percent margin over Lynch, with a turnout of more than 530,000 Democratic voters. All of the candidates are vying for Secretary of State John Kerry's Senate seat, now held by interim Sen. Mo Cowan (D). 		<description><![CDATA[The “Gang of Eight” Senators continue to work to finalize details of comprehensive immigration reform. There continues to be few public details on the larger package, such as the worker verification process or the employer sanctions.  However, the future temporary worker visa program continues to have a unique and arbitrary restriction on the construction industry’s use of a future guestworker program.  In fact, it appears that the construction industry may even be further carved out if the program allows construction occupations that are ineligible for construction companies to be eligible in other industries. The timeline for a final deal and legislative language appears to have slipped into next week at the earliest.]]></description>

AGC and the Transportation Construction Coalition (TCC) scored a major victory last year when the “Moving Ahead for Progress in the 21st Century Act” (MAP- 21) became law. The legislation provided a two-year authorization through the end of FY 2014 and sufficient revenue to support current funding levels. With this major victory behind us, now is the time to address the long term viability of the Highway Trust Fund (HTF) by providing the revenue necessary to fix the nation’s current and growing transportation investment deficit. The report is another in a series of government reports highlighting the underlining problems of the pension system and the need for substantive changes to the system. AGC has been working in a cross industry, labor and management coalition advocating for private sector solutions that would improve the ability of plans to keep contributing employers, improve retirement security for participants, and help prevent the need for taxpayer funds of the PBGC in the future. 		<description><![CDATA[With the enactment of sequestration and final passage of FY 2013 continuing appropriations, which set funding levels through Sept. 30, 2013, we now know the total dollars appropriated for the SRF and RUS programs and have a more complete picture of future water infrastructure funding. The Clean Water SRF received $1.45 billion and the Drinking Water SRF received $908.7 million – a total cut for the SRFs of $27.5 million, or a 1 percent reduction from FY 2012. The RUS Rural Water and Waste Disposal Loan Program, however, was one of the few winners in this year’s appropriations fight. The program received $524.4 million, an increase of $11.4 million, or 2 percent, over FY 2012.]]></description>

He indicated after 36 consecutive years in elective office – including service in the state legislature, and combined time in the U.S. House and Senate – that he and his wife are looking forward to returning to life in South Dakota and "doing other things." Johnson conceded that the brain hemorrhage he suffered in 2006 has made life more difficult, but emphasized that he never stopped working hard for the people that repeatedly elected him as their representative.]]></description>
