Administration Outlines Federal Environmental Agenda

The Trump Administration released its regulatory “to do list” for the near term—including redo of species regulations, the definition of waters of the United States, and management of forever chemicals.

Twice a year the Federal Government publishes the Unified Agenda that provides transparency on those regulatory initiatives the agencies are advancing, the stage in the process, and projected completion dates. AGC of America tracks and responds to several environmental regulatory actions due to their relevance to the construction industry, highlighted below.

Army Corps of Engineers

  1. Reissuance and Modification of Nationwide Permits
  2. Appendix C Procedures for the Protection of Historic Properties

Environmental Protection Agency

  1. Per- and Polyfluoroalkyl Substances (PFAS) Requirements in National Pollutant Discharge Elimination System (NPDES) permits
  2. Waters of the United States (WOTUS)
  3. Clean Water Act (CWA) Section 401 State Water Quality Certification Implementation Rule
  4. Updates to the Resource Conservation and Recovery Act (RCRA) Hazardous Waste Regulations and Related Technical Corrections – Permitting Updates Rule
  5.  Listing of Specific PFAS as Hazardous Constituents under RCRA
  6. PFAS Data Reporting and Recordkeeping under the Toxic Substances Control Act (TSCA); Revision to Regulation
  7. Addition of Certain PFAS to the Toxics Release Inventory (TRI)
  8. Updates to Procedures for Implementing the National Environmental Policy Act and Assessing the Environmental Effects of EPA Actions
  9. Revisitation of the 2024 Reconsideration of the National Ambient Air Quality Standards for Particulate Matter
  10. Reconsideration of the Greenhouse Gas Reporting Program

Fish and Wildlife Service

  1. Regulations for Listing Endangered and Threatened Species and Designating Critical Habitat
  2. Endangered and Threatened Wildlife and Plants; Interagency Cooperation
  3. Regulations for Designating Critical Habitat 
  4. Regulations Pertaining to Endangered and Threatened Wildlife and Plants  
  5. Rescinding the Definition of “Harm” Under the Endangered Species Act
